What happens if there is no access legislation? Does this mean you don’t need prior consent?

    Yes- the country is not exercising access rights. This does not mean you can go collect whatever you want! For example, Brazil has access legislation but is not yet a party to the protocol, so you need to work with their requirements but not go through the Nagoya procedure.
